1. Parties & acceptance

These Terms & Conditions ("Terms") govern your use of the Domi Karibe website, web application, and mobile application (together, the "Platform"). The Platform is operated by Cutelia, registered with the Curaçao Chamber of Commerce (KvK) under number 165843 ("Domi Karibe", "we", "our", "us"). By creating an account, publishing content, or otherwise using the Platform, you accept these Terms. If you do not agree, do not use the Platform.

2. Definitions

• Seeker: an individual using the Platform to find property, mortgages, or insurance.
• Pro: a verified real-estate professional, developer, or owner publishing Listings.
• Bank / Insurer: a financial institution receiving mortgage or insurance Leads through the Platform.
• Listing: a property advertisement published on the Platform, whether submitted directly by a Pro or imported from a verified agent website under the "agent-imported" label.
• Lead: an enquiry, message, or quote request you send to a Pro, Bank, or Insurer through the Platform.
• Subscription: a recurring paid plan granting Pros, Banks, or Insurers access to professional features.
• Boost: a one-off paid feature that promotes a specific Listing.

3. Account eligibility & security

You must be at least 16 years old to create a Seeker account and at least 18 years old to create a Pro, Bank, Insurer, or paying account. One account per person or per legal entity. You are responsible for keeping your credentials secure and for all activity under your account. Notify us immediately at the contact form of any suspected unauthorised use.

4. Roles & responsibilities

• Seekers use the Platform free of charge to browse Listings, save searches, contact Pros, and request mortgage or insurance quotes.
• Pros may publish Listings only after verification (valid KvK registration plus a working website and reachable contact channel). Pros publish under a paid Subscription and must keep all Listing information accurate, lawful, and up to date.
• Banks & Insurers receive Leads matching their published criteria and must respond in accordance with applicable financial-services regulations.
• Admins moderate the Platform and may verify, suspend, or remove accounts and content.

5. Listings

Pros warrant that they hold the legal right to market each property listed, and that all media, prices, descriptions, and locations are accurate and lawful. Domi Karibe may edit, unpublish, or remove any Listing that breaches these Terms, applicable law, or third-party rights, with or without notice. Listings imported from publicly accessible agent websites are clearly labelled "agent-imported"; the originating agent remains responsible for accuracy and can request removal at any time via the contact form.

6. Subscriptions, Boost fees, billing & refunds

Subscriptions and Boost fees are billed in the currency and at the price displayed at checkout. Subscriptions renew automatically for successive periods unless cancelled before the next renewal date. Fees are non-refundable except where mandatory law requires otherwise. We may change pricing with at least 30 days' notice; price changes do not affect the current billing period.

7. Lead use

Lead data received through the Platform may be used solely to respond to that specific enquiry. You may not resell, re-share, enrich, or use Lead data for marketing, profiling, or any other purpose without the Seeker's separate consent.

8. Acceptable use

You agree not to: (a) commit fraud, misrepresent your identity or credentials, or post false information; (b) scrape, harvest, or mass-export Platform content; (c) circumvent paid features, verification, or rate limits; (d) upload malware or content infringing third-party rights; (e) harass, threaten, or discriminate against other users; (f) interfere with the security or integrity of the Platform.

9. Intellectual property

The Platform, including its software, design, brand, and aggregated data, is owned by Cutelia and protected by intellectual-property laws. By submitting Listings, photos, reviews, or other content, you grant Domi Karibe a non-exclusive, worldwide, royalty-free licence to host, display, adapt, and distribute that content for the purpose of operating, promoting, and improving the Platform. You retain ownership of your content.

10. Disclaimers

Domi Karibe is a marketplace and information service. We are not a real-estate agent, mortgage broker, insurer, or party to any sale, rental, mortgage, or insurance contract concluded between users. Mortgage calculators, market data, "Deep Scan" analyses, and similar tools are indicative only and must not be relied upon as financial, legal, or investment advice. The Platform is provided on an "as is" and "as available" basis to the extent permitted by law.

11. Limitation of liability

To the maximum extent permitted by law, Domi Karibe is not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Platform. Our aggregate liability for direct damages arising from your use of the Platform in any 12-month period is limited to the amount you paid us in that period, or USD 100, whichever is greater. Nothing in these Terms limits liability that cannot be excluded under applicable law.

12. Indemnity

Pros, Banks, and Insurers agree to indemnify and hold Domi Karibe harmless from any third-party claim arising from their Listings, responses, marketing, or breach of these Terms or applicable law.

13. Suspension & termination

We may suspend or terminate any account that breaches these Terms, the law, or the rights of others, or where required by a competent authority. You may close your account at any time via your account settings or by writing to the contact form. Sections that by their nature should survive termination will survive.

14. Governing law & jurisdiction

These Terms are governed by the laws of Curaçao. Any dispute arising out of or in connection with these Terms or your use of the Platform will be submitted to the exclusive jurisdiction of the Court of First Instance of Curaçao.

15. Changes

We may update these Terms from time to time. Material changes will be announced in-app or by email. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
